Terms and conditions of ordering from A2 Disain OÜ e-shop


A2 Disain OÜ, registration code: 14659004, address: Plasti, Mäo, Paide, Järvamaa, 72751 (hereinafter referred to as the Online Shop) is the owner of the online shop www.a2disain.ee (hereinafter referred to as the Online Shop) and the Customer is the person who places an order and orders goods from the Online Shop.

 

      1. Validity of the sales conditions

  • The terms and conditions of sale apply to the purchase of products and services between the purchaser (hereinafter the Customer) and the company A2 Disain OÜ (hereinafter the Online Shop www.kidsplayhouses.eu) from a2disain.ee online store.
  • In addition to these terms and conditions, legal relations arising from the purchase of products from kidsplayhouses.eu webshop are governed by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA) and other legislation in force in the Republic of Estonia.
  • The online shop a2disain.ee reserves the right to make changes to the terms and conditions of sale and sale prices. These changes will be reflected on the website.

     

      2. Prices

  • All prices in the kidsplayhouses.eu Online Shop are in euros (€) and include VAT at 22%.
  • The prices are valid from the time of placing the order until the expiry of the payment term of the placed order (7 days after placing the order).
  • If the order is placed before the conditions of sale or prices have been modified, the legal relations between the Subscriber and kidsplayhouses.eu shall be governed by the conditions in force at the time the order was placed.
  • Product prices do not include transport.

       3. Placing an order
  • It is possible to pay for products by invoice (ask for an invoice by email) , as well as by paying at the Online Store checkout.
  • Add the products you want to your shopping cart.
  • To place your order, click on the PAY NOW button in the shopping cart.
  • On the order page, fill in the required fields and press CONFIRM.
  • When you click on the CONFIRM ORDER button, you will be redirected to the Card details page where you can make the payment by payment card.
  • Once the payment is successful, you will be redirected to the order confirmation page.

      4. Payment methods
    • By invoice, contact us and we will send you an invoice to pay for your order.

          5. Product information
    • Information about the products can be found in the Online Shop under the product
    • The product images shown are for illustrative purposes only and may differ from the actual product.

            6. Enforcement of the sales contract
      • The sales contract will enter into force when the payment made by the Contracting Entity is credited to our bank account.
      • Outstanding and unpaid orders will be canceled 7 days after the order has been placed.

            7. Delivery conditions

      • Prices in the shop are without delivery.
      • Before placing an order, please contact us and specify the delivery price. Delivery charges will be invoiced prior to delivery of the order.
      • After the sales contract has become effective, the Online Shop will complete the order and inform the Customer of the estimated delivery time by telephone or e-mail indicated on the order.
      • The online shop kidsplayhouses.eu will deliver the goods only to the address indicated by the Customer when placing the order.
      • The online shop shall not be liable for delays in the delivery of goods and misunderstandings if they are caused by inaccuracies in the information provided by the Customer when placing the order. Or if the delay is due to circumstances which the Online Shop could not influence or foresee. 
      • The Customer must ensure that a person authorized and able to receive the delivery is present at the delivery address and is available by telephone.
      • If there is no one on site to receive the delivery, the Online Shop will take the goods back to its warehouse at the expense of the Customer.

             8. Right of return

      • After placing an order, the Customer has the right to return the ordered products within 14 days, except for special orders or products with modifications made at the request of the Customer.
      • The product to be returned must be unopened and in its original packaging.
      • In order to return a product, the Customer must notify us in writing by e-mail to info@kidsplayhouses.eu. The Customer will be contacted and the return of the goods will be coordinated as soon as possible, but not later than 14 days.
      • The return of the goods shall be arranged and paid for by the Customer.
      • The Online Shop will return to the Customer, after taking possession of the product, and not later than 14 days, all payments received from the Customer.
      • The right of return does not apply to legal persons. For the purposes of the Consumer Protection Act, a consumer is a private individual.
      • The money will be refunded to the same account from which it was received by the Online Shop.

            9. Force Majeure

      • The online shop kidsplayhouses.eu is not liable for damages caused to the Customer or for the delay in the delivery of the goods, if the damage or the delay in the delivery of the goods is caused by circumstances that the Online Shop kidsplayhouses.eu could not influence or foresee.

           10. Privacy Policy, Processing of Personal Data

      • The owner of the online shop and the controller of personal data is A2 Disain OÜ.
      • The Data Protection Specialist is a member of the Management Board, whose e-mail address is info@a2disain.
      • The online shop processes personal data in accordance with Article 6(1)(a), (b), (c), (f) of the General Data Protection Regulation.
      • With the consent of the subscriber, the online shop processes personal data for the purposes of Article 6(1)(a) of the GDPR. The Subscriber may withdraw his/her consent to the processing of personal data for this purpose at any time.
      • In the cases provided for by law, the online shop processes personal data pursuant to Article 6(1)(e) GDPR.
      • The online shop processes the following personal data.
      • The name, telephone number and e-mail address of the customer.
      • Delivery address.
      • Name and number of the payer's bank account holder.
      • The cost of the products and services and the payment details.
      • Customer support contact details.
      • List of purchases.
      • Personal data is used for the management of the Subscriber's orders, delivery of products.
      • Purchase history data (date of purchase, goods, quantity, customer details) is used to compile an overview of products and services purchased and to analyse customer preferences.
      • The name and number of the bank account holder is used to refund payments to the Subscriber.
      • Personal data, such as e-mail, telephone number, name of the Subscriber, are processed in order to resolve issues related to the provision of products and services.
      • The IP address or other network identifiers of the user of the online shop are processed for the purposes of providing the online shop as an information society service and for web usage statistics.
      • Personal data will also be transferred to the customer support of the online shop for the purpose of managing purchases and purchase history and resolving customer issues. The online shop transfers the personal data necessary for the execution of payments to the processor Maksekeskus AS for the purpose of making payments.
      • The name, telephone number and e-mail address of the Subscriber will be transmitted to the transport service provider chosen by the Subscriber. In the case of goods to be delivered by courier, in addition to the contact details, the address of the Subscriber and the details provided by the Subscriber will also be transmitted to the carrier.
      • The data of the Contracting Entity shall be transmitted to the accounting service provider for the purpose of drawing up accounting documents, keeping accounting records and fulfilling legal obligations relating to accounting.
      • The online shop may transfer the customer's personal data to information technology service providers if this is necessary to ensure the functionality of the online shop or to ensure data availability.
      • Personal data are stored on the servers of service providers located in the territory of a Member State of the European Union or in the territory of the countries that are members of the European Economic Area. Data may be transferred to countries whose level of data protection has been assessed as adequate by the European Commission and to companies in the United States that have signed up to the Privacy Shield framework.
      • Access to personal data is granted to the employees of the online shop who can access personal data in order to resolve technical issues related to the use of the online shop and to provide customer support services.
      • The online shop implements appropriate physical, organisational and IT security measures to protect personal data against accidental or unlawful destruction, loss, alteration or unauthorised access and disclosure. Confidentiality agreements are concluded with all persons having access to personal data.
      • Transfers of personal data to processors (e.g. transport service providers and data aggregators) of the online shop are carried out on the basis of contracts between the online shop and the processors. The processors are obliged to ensure appropriate safeguards for the processing of personal data.
      • Where the processing of personal data is based on the consent of the customer, the customer has the right to withdraw the consent by informing the online shop by e-mail.
      • When the online shop closes the customer's account, the personal data will be deleted, unless such data need to be kept for accounting purposes, national statistics or the settlement of consumer disputes.
      • Purchase history will be kept for 3 years.
      • In the event of disputes relating to payments and consumer disputes, personal data will be kept until the claim is settled or the limitation period expires.
      • Personal data necessary for accounting purposes are kept for seven years.
      • If you wish to have your personal data deleted, please contact the online shop by e-mail. A reply to the deletion request will be sent within two weeks at the latest, specifying the period of deletion.
      • Any request for transfer of personal data made by e-mail will be answered within one month at the latest. The online shop will verify the identity and inform you of the personal data to be transferred.

      • Where personal data are processed for the purposes of direct marketing (profiling), the Subscriber has the right to object at any time to both the initial and further processing of his/her personal data, including profiling in relation to direct marketing, by informing the online shop by e-mail (this information must be provided clearly and separately from any other information).
      • Complaints and questions relating to the processing of personal data may be sent to the webshop by e-mail to info@kidsplayhouses.eu.
      • In order to settle disputes related to the processing of personal data, the data subject may contact the Data Protection Inspectorate (Tatari 39, 10134 Tallinn; +372 627 4135; info@aki.ee; aki.ee) or the Estonian courts.

           11. Complaints procedure
      • In the case of a defective product, the Customer has the right to submit a complaint to the Online Shop within two years from the date of receipt of the product.
      • The Online Shop shall not be liable for defects in the product caused by improper installation, improper use and/or improper maintenance.
      • The online shop shall not be liable for defects in the product which have arisen during normal wear and tear.
      • In the event of a defect in the product, the product must be discontinued immediately and the Webshop must be informed immediately of the defect.
      • In the event of non-compliance or defects of the product, please send a complaint to the e-mail address info@kidsplayhouses.eu, indicating the name of the person placing the order, the contact telephone number and a precise description of the non-compliance or defect.
      • Complaints concerning non-compliance or defects must be submitted no later than two months from the date of discovery of the non-compliance or defect.
      • All complaints will be examined and the Customer will be contacted as soon as possible, but not later than 14 days after receipt of the complaint.
